Community Guidelines & Terms of Use

These Community Guidelines and Terms of Use ("Terms") constitute a legally binding agreement between you ("User," "Vendor," or "Visitor") and SmartWeddingPlans Inc. ("SmartWeddingPlans," "we," "our," or "us"), governing your access to and use of the SmartWeddingPlans.ca website, mobile applications, and any related services (collectively, the "Platform").

By accessing or using the Platform in any manner, including but not limited to browsing, creating an account, submitting a vendor listing, posting content, or contacting another user, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy.

If you do not agree to these Terms, you must immediately cease all use of the Platform. SmartWeddingPlans reserves the right to modify these Terms at any time. Continued use of the Platform following any modifications constitutes your acceptance of the revised Terms.

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Ontario, Canada.

The Platform is intended for use by individuals who are at least 18 years of age. By using the Platform, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding agreement.

To list a business on SmartWeddingPlans, you must register an account and provide accurate, complete, and current information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

You agree to notify SmartWeddingPlans immediately at support@smartweddingplans.ca of any unauthorized use of your account or any other breach of security. SmartWeddingPlans will not be liable for any losses arising from unauthorized use of your account.

One free listing is permitted per individual business. Attempts to circumvent this limitation by creating multiple accounts, using alternate email addresses, or any other means constitute a violation of these Terms and may result in permanent removal from the Platform.

All content submitted to SmartWeddingPlans — including but not limited to business names, descriptions, photographs, logos, portfolio images, website URLs, social media links, and any other materials — must comply with the following standards.

3.1 Prohibited Text Content

You must not submit any text content that:

• Contains racial, ethnic, or religious slurs or derogatory language targeting any group;
• Constitutes hate speech, discriminatory language, or content that promotes hostility toward individuals based on race, ethnicity, national origin, religion, sex, gender identity, sexual orientation, disability, or any other protected characteristic under Canadian federal or provincial law;
• Includes explicit profanity, vulgar language, or sexually explicit text;
• Contains threats of violence, intimidation, or language promoting harm toward any person or group;
• Constitutes defamation, libel, or slander against any individual, business, or organization;
• Includes misleading, deceptive, or fraudulent claims about your business, services, qualifications, pricing, or certifications;
• Contains spam, unsolicited advertising, or promotional content unrelated to your wedding vendor services;
• Infringes upon any copyright, trademark, trade secret, or other intellectual property right of any third party;
• Violates any applicable local, provincial, federal, or international law or regulation.

3.2 Prohibited Image Content

You must not submit any images or visual content that:

• Depicts nudity, partial nudity, or sexually suggestive imagery of any kind;
• Contains sexually explicit or pornographic material;
• Depicts violence, gore, graphic injury, or death;
• Includes images of weapons, including firearms, knives, or other implements of harm;
• Displays hate symbols, neo-Nazi imagery, or symbols associated with any terrorist, extremist, or hate group;
• Infringes upon the rights of any identifiable third party without their express written consent, including images of individuals who have not consented to their likeness being used in this context;
• Contains watermarks, branding, or logos belonging to competitor platforms or services without authorization.

3.3 Prohibited URLs and External Links

Any website URLs submitted as part of your vendor profile must direct users to legitimate, professionally appropriate business websites. Links to adult content websites, gambling platforms, illegal services, phishing pages, malware-distribution sites, or any other inappropriate external destinations are strictly prohibited.

All vendor submissions are subject to review prior to publication on the Platform. SmartWeddingPlans employs a combination of automated artificial intelligence content moderation and human review to evaluate all submitted content for compliance with these Guidelines.

Upon submission, your listing will be assigned a status of "Pending Review." The review process typically takes between 24 and 48 hours. You will be notified by email of the outcome of your review.

If your submission is approved, your listing will be published on the Platform and you will receive a confirmation email. If your submission is rejected, you will receive a notification explaining the nature of the violation. You may revise and resubmit your listing in compliance with these Guidelines.

SmartWeddingPlans reserves the right, in its sole discretion, to remove, modify, or refuse to publish any content that violates these Guidelines or that we determine to be otherwise inappropriate, offensive, or contrary to the interests of the Platform and its users, at any time and without prior notice.

SmartWeddingPlans does not guarantee the accuracy, completeness, or reliability of any vendor listing or user-submitted content appearing on the Platform. We are not responsible for verifying vendor credentials, licensing, or qualifications unless explicitly stated.

Violations of these Community Guidelines will be taken seriously and may result in consequences up to and including permanent removal from the Platform. The severity of enforcement action will be commensurate with the nature and frequency of the violation.

5.1 First Violation

Upon detection of a first violation, SmartWeddingPlans will reject the offending submission and notify the vendor by email. The vendor will be given the opportunity to revise and resubmit their content in compliance with these Guidelines.

5.2 Repeat Violations

Vendors who submit content that violates these Guidelines on more than one occasion may be permanently banned from the Platform. A permanent ban entails the removal of all associated listings and the addition of the vendor's email address and business name to our permanent block list. Banned vendors may not create new accounts or submit new listings using any email address or business identity.

5.3 Reporting to Authorities

SmartWeddingPlans will report repeat offenders and any submissions containing illegal content to the appropriate authorities. This includes, but is not limited to, submissions containing child exploitation material, content promoting or inciting violence, content constituting criminal harassment or threats, and any other content that may constitute a criminal offence under the Criminal Code of Canada or applicable provincial legislation. We cooperate fully with law enforcement agencies and will provide user data, submission records, IP addresses, and any other relevant information upon lawful request.

5.4 Immediate Removal for Serious Violations

Certain categories of prohibited content — including but not limited to child sexual abuse material, credible threats of violence, and content constituting hate crimes — will result in immediate and permanent account suspension without warning, along with a mandatory report to the Canadian Centre for Child Protection, the RCMP, local police services, or other appropriate authorities.

SmartWeddingPlans maintains a permanent block list of email addresses and businesses that have been removed from the Platform due to serious or repeated violations of these Guidelines.

If your email address or business has been permanently blocked, you will receive a notification indicating that your account has been suspended. Any attempt to create a new account or submit a new listing using the same or a different email address while under a permanent block constitutes a further violation of these Terms.

If you believe your account has been blocked in error, you may contact SmartWeddingPlans at support@smartweddingplans.ca to appeal the decision. Appeals are reviewed at our sole discretion and we are under no obligation to reinstate any blocked account.

By submitting content to SmartWeddingPlans, you represent and warrant that you own or have obtained all necessary rights, licenses, consents, and permissions to submit and display such content on the Platform.

You grant SmartWeddingPlans a non-exclusive, royalty-free, worldwide, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your submitted content in connection with the operation and promotion of the Platform, including on social media channels and marketing materials.

The SmartWeddingPlans name, logo, website design, and all associated content, software, and materials are the exclusive intellectual property of SmartWeddingPlans Inc. and are protected by Canadian and international copyright, trademark, and other intellectual property laws. You may not copy, reproduce, distribute, or create derivative works based on any SmartWeddingPlans content without our express written permission.

By using the Platform, you consent to the collection, use, and disclosure of your personal information as described in our Privacy Policy. We collect personal information including your name, email address, business name, phone number, and any other information you provide in connection with your vendor listing.

Your information may be shared with third-party service providers who assist us in operating the Platform, conducting our business, or serving our users, provided those parties agree to keep your information confidential. We comply with the Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable provincial privacy legislation.

We may retain records of submitted content, including rejected and removed submissions, for legal compliance, fraud prevention, and law enforcement cooperation purposes. This data is stored securely and accessed only on a need-to-know basis.

SmartWeddingPlans.ca provides an AI-powered chatbot named "Vanessa" as a convenience feature. All responses generated by Vanessa are for informational purposes only and do not constitute professional, legal, financial, or contractual advice of any kind.

SmartWeddingPlans Inc., its owner(s), officers, directors, employees, and affiliates expressly disclaim all liability for any loss, harm, damage, or consequence arising from your use of or reliance on any information, suggestion, or response generated by the AI assistant. This includes but is not limited to decisions made regarding vendors, contracts, budgets, timelines, or any other wedding-related matter.

The AI assistant may produce inaccurate, incomplete, outdated, or misleading content. We do not review or verify individual AI responses. You acknowledge the inherent limitations of AI technology and agree that you are solely responsible for independently verifying any information before acting on it. Your interaction with Vanessa does not create any professional, advisory, or fiduciary relationship with SmartWeddingPlans.ca or its owner.

The Platform and all content, services, and materials available through it are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

SmartWeddingPlans does not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any content appearing on the Platform.

To the fullest extent permitted by applicable law, SmartWeddingPlans shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, goodwill, data, or other intangible losses, arising from your use of or inability to use the Platform, or from any content submitted by vendors or other users.

Our total cumulative liability to you for all claims arising out of or relating to these Terms or your use of the Platform shall not exceed the greater of (a) the total amount paid by you to SmartWeddingPlans in the twelve months preceding the claim, or (b) one hundred Canadian dollars (CAD $100.00).

You agree to defend, indemnify, and hold harmless SmartWeddingPlans Inc., its officers, directors, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms, your use of the Platform, your submitted content, your violation of any third-party rights, or your violation of any applicable law or regulation.

SmartWeddingPlans reserves the right, in its sole discretion, to terminate or suspend your access to the Platform at any time, with or without cause, and with or without notice, effective immediately. Upon termination, your right to use the Platform will immediately cease.

You may terminate your account at any time by contacting us at support@smartweddingplans.ca. Termination of your account does not entitle you to a refund of any fees paid for active subscriptions, except as required by applicable law.

Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
